Terms of service

These Terms of Service or General Conditions govern the purchases made on the site www.incontrishop.com (the "Site" or "incontrishop.com"), the use of the Site as well as the services provided through the Site, in accordance with the provisions of Legislative Decree no. 70/2003 on information society services and electronic commerce and the provisions of Part III, Title III, Chapter I, of the Consumer Code, d. lgs. 206/2005, as amended by d.lgs. 21/2014.
The provider of the Services covered by the General Conditions is the company:

Incontri S. r.l. with registered office (coinciding with the geographical address where Incontri is established) in Milan, Corso Sempione n. 88, enrolled in the Register of Companies of Milan under number 07241440960, Tax Code and VAT No. 07241440960, REA 1947004, Share Capital € 30. 000,00 fully paid up, hereinafter referred to as "INCONTRI", certified e-mail address incontrisrl@pec.it

INCONTRI is always contactable by e-mail (modaincontri@modaincontri.com), fax (+3902314530) or by phone (+39463101).
For any legal information it is recommended to consult also the following dedicated sections: Cookies and Privacy Policy, Right of Withdrawal.
The General Conditions do not apply to the possible sale of products or provision of services by third parties present on the Site through links, banners or other hypertext links, for which INCONTRI cannot in any way be held responsible.
In view of the commercial policy chosen by INCONTRI, the use of the Services, and the online purchase of products, is permitted solely to consumer users who are natural persons, of legal age, who access the Site for purposes not related to any commercial, entrepreneurial or professional activity carried out (the "Customer").
The General Conditions may be subject to modification and the date of publication on the Site is equivalent to the effective date. The General Conditions applicable are those in force on the date of sending the purchase order.

Object of the contract

By this contract, respectively, INCONTRI sells and the Customer purchases at a distance, exclusively via Internet, the tangible movable goods illustrated and offered for sale on the Site  www.incontrishop.com.
The customer agrees to read carefully, before formalizing the proposed purchase, the General Conditions and pre-contractual information indicated below, and to accept them through the checkbox on the checkout page and prepared for this purpose, as specified below.
In the order confirmation email there will be a link to the General Conditions, which the customer can store and archive, in accordance with the provisions of Article 51, paragraph 1, of the Consumer Code, as amended by Legislative Decree 21/2014.


Pre-contractual information for the consumer

Before concluding the purchase contract, the Customer takes vision of the characteristics of the products offered for sale on the Site that are illustrated in the single product sheets accessible from each section.
Before the validation of the order with obligation of payment, INCONTRI makes available on the site or through this document the following information to the Customer:


  • A summary of the essential characteristics of the goods, which are illustrated in the individual product sheets already viewed.
  • The total price of the products including taxes, with the details of shipping and any other cost.
  • The mode of payment, delivery and execution.
  • The term within which INCONTRI undertakes to deliver the goods.
  • The conditions, terms and procedures for exercising the right of withdrawal, as well as the standard withdrawal form set out in Annex I, Part B of Legislative Decree 21/2014.
  • The information that the Customer will have to bear the cost of returning the goods in case of exercising the right of withdrawal.
  • The geographical address where INCONTRI is established, telephone number, fax, e-mail.
  • The conditions of after-sales assistance and legal guarantee of conformity of the goods purchased.
  • The possibility of using an extrajudicial mechanism of complaint and appeal (www.risolvionline.com).


Manner of concluding the contract

The languages available to the Customer to conclude this contract are Italian and English.
To be able to make purchases the mandatory registration is required by the customer who, once registered, will have full access to his profile and the management of his data.
If the customer intends to register, he must click on the appropriate link "Register" visible by clicking on the Login button of the Site and in any case before being able to make a purchase and enter the required data.

The information sent will be used by INCONTRI only for the management of the account and to conclude the sales contract as well as to keep the correspondence necessary for this purpose.

At the end of this procedure, the Customer receives, at the e-mail address indicated, an e-mail with the details of the account just created as a reminder to make subsequent accesses. In case the Customer loses one or both of the data necessary for the access, he/she can ask for them through the appropriate link in the access form of the Site.

When purchasing, the Customer must read the General Conditions and confirm the acknowledgement and acceptance of the General Conditions by clicking on the appropriate box at the time of purchase.

The products can be viewed and selected through the product sheets published on the Site.
The product is selected for purchase by the Customer and placed in the cart by clicking on the "Add to Cart" button.
In the header of each page is always visible an icon with the link to the cart.
It is always possible for the customer, before submitting the order, to identify and correct errors in data entry or remove items from the cart and / or change the quantity, size and / or color you want to buy.
After viewing and verifying the products placed in the cart, the Customer carries out the order procedure by clicking on the "Go to cart" button; a screen opens in which the Customer can access his account if already registered or register by clicking on the appropriate link. On the next screen, the Customer is asked to enter the following mandatory data:


User information:
- email address;
- username (the login name);
- name (the nickname that will be used in communications with the Customer);
- password (a password of at least 8 alphanumeric characters).


Billing Data
- first name
- last name;
- fiscal code (for italian users);
- address;
- c. a.p. ;
- municipality;
- country;
- province;
- phone;


You are also asked to confirm that you have read and accept the terms of the Privacy Policy.

The Customer, after the insertion of the requested data, indicates, by clicking the box "Shipping data", if the data inserted for invoicing purposes coincide or not with the shipping data. If the data are different, the Customer is invited to fill in the fields necessary for shipment to a different address. The customer can still report any changes even later at the time of each purchase.

In the table below the cart, the customer selects the Shipping Method among those available for the country indicated and clicks on Save; Selects the Payment Method; If the customer is in possession of a discount coupon insert it in the appropriate space and click on Save.

The Customer clicks on the Buy Now button, then accesses the final screen, in which there is a summary of the items placed in the cart and the total amount of the order (including shipping costs).
Before proceeding, the Customer is required to read the General Conditions that are visible at the link at the bottom. After reading, the customer accepts the conditions by selecting the checkbox.

The customer, therefore, before confirming the order and make the payment, has the opportunity to carefully check the contents of the cart and the relative purchase price of the goods as well as view a summary page of all the elements of the contract to be concluded, which in confirmation of the order will be sent by e-mail to the customer.

Finally, to send the order, the Customer clicks on "Confirm the order".

If the Customer has selected the PayPal or Credit Card payment method, he is redirected to the Paypal page for the payment.

INCONTRI reserves the right to evaluate the conclusion of sales in countries where its activity is not directed.
INCONTRI then without undue delay sends the Customer an e-mail reminding him of the order received with the relative identification number.
The contract of sale is considered concluded when the Customer receives a subsequent e-mail with which INCONTRI confirms that the order has been accepted and that the ordered goods are prepared for shipment (the "Order Confirmation E-mail"). The Order Confirmation E-mail contains a summary of all the elements of the contract and precisely:

  • Customer data
  • The order number
  • The information related to the essential characteristics of the goods chosen
  • The detailed indication of the price of the goods purchased, the shipping costs applicable taxes and means of payment
  • The delivery address to which the goods will be sent
  • The link to the General Conditions

INCONTRI reserves the right to refuse orders placed by a Customer who has previously violated the General Conditions, with whom legal actions or disputes are pending, who has abusively exercised his right of withdrawal, who has carried out fraudulent activities. In such cases no contract shall be considered concluded and INCONTRI shall communicate by e-mail the non-conclusion of the contract and the cancellation of any charges made.


Product availability

INCONTRI assures, through its computer system, the elaboration and evasion of orders without undue delay.
However, due to the simultaneous presence on the site of several users and the high number of potential transactions, the products presented on INCONTRI.com may no longer be available at the time of the order by the customer.
INCONTRI will promptly communicate, and in any case within 30 days starting from the day after the day the order has been forwarded by the Customer, what the waiting time is to obtain the chosen good and in that case will ask the Customer if he intends to confirm the order or not, or the unavailability of the ordered products and will refund, without undue delay, to the Customer the payment made.
Even after the Order Confirmation E-mail sent by INCONTRI, cases of partial or total unavailability of the products could occur and in this case the Customer will be informed immediately by e-mail and refunded without undue delay. This contract will be considered terminated by law.


The sale prices of the products on the Site are expressed in Euro and are inclusive of VAT.
Shipping costs are not included in the sale price but are indicated when the Customer displays the different shipping services available, among which to choose and calculated at the conclusion of the purchase process before making the payment.
The Customer accepts INCONTRI's right to modify its prices at any time. In any case, the goods shall be invoiced on the basis of the prices published on the Site at the time of placing the order by the Customer and corresponding to those indicated in the summary page visible before sending the order itself through the "Continue to authorize payment" button.
In case of errors that determine a substantial modification of the sale price such as to make it clearly excessive or derisory, the purchase order by the Customer will be cancelled and the price paid will be refunded without undue delay and in any case within 14 days from the cancellation.

Method of Payment

Payment by Customer may be made by the following methods:
Paypal online payment system (payment via PayPal account or Credit Card);
Bon transfer, upon Customer request sent to Customer Care (customercare@modaincontri.com).
The actual debit occurs only after INCONTRI has provided (ii) to send the Order Confirmation E-mail and (ii) to prepare the goods for shipment.
If for any reason the debit is impossible, the sale process is cancelled.

Guarantees and assistance

The products offered for sale on INCONTRI. com are original products supplied to INCONTRI by manufacturers and retailers selected among the most highly qualified operators in Italy and abroad.
The product sheets published on the Site contain a description of the essential characteristics of the products on sale.
May occur errors, inaccuracies or small differences between the descriptions contained in the Site and the actual product, which INCONTRI undertakes to correct as soon as possible from the report. In addition, the photographs of the products presented do not constitute a contractual element as they are merely representative.
INCONTRI shall be liable for any lack of conformity existing at the time of delivery of the goods purchased on the Site, which becomes apparent within two years from delivery of the goods.
The Customer shall lose any right if he does not report the lack of conformity to the Seller within
the term of two months from the date in which the defect was discovered.
In case of lack of conformity, the customer will be entitled to obtain, following the complaint, alternatively and without charge, the repair or replacement of the property purchased within a reasonable period of time, unless the request is objectively impossible to satisfy or is excessively expensive.
The complaint must be made in writing, by registered letter with return receipt or by e-mail to INCONTRI, to which must be attached the fiscal documentation produced on INCONTRI. com; INCONTRI shall indicate its willingness to give effect to the request, or the reasons that prevent it from doing so, within seven working days from receipt of the complaint.
In the event that INCONTRI can give effect to the request, the Customer shall follow the return procedure for the return of the product. Once the goods have been received and the reported conformity defect has been verified, INCONTRI shall inform the Customer of the deadline for the return of the repaired goods or for the replacement of the defective goods or the reasons preventing him from doing so.
If the repair and replacement are impossible or excessively expensive, or INCONTRI has not repaired or replaced the goods within the above term or, finally, the replacement or repair previously carried out have caused significant inconvenience to the Customer, the same may request, at its option, a reasonable reduction in price or termination of this contract, limited to the goods in dispute.
The Customer will have in this case to send his request to INCONTRI specifying the modalities for the total or partial re-credit of the sums previously paid.
INCONTRI will then have to indicate the proposed price reduction or the modalities for the return of the defective goods (if in the availability of the Customer) and then provide for the total or partial re-credit.
Any conventional warranties relating to products sold are provided directly by the manufacturer or retailer, whose existence and duration are specified in the relevant product sheets.
Communications and complaints
Written communications directed to INCONTRI and any complaints will be considered valid if sent to the following address: Corso Sempione 88, 20154 Milan, or sent by email to the following address: customercare@modaincontri.com.
The Customer indicates in the registration form his residence or domicile, the telephone number and the e-mail address (the latter is compulsory) to which he wishes to receive communications from INCONTRI.
Limitations of responsibility
INCONTRI declines all responsibility for inefficiencies attributable to force majeure or fortuitous event, even dependent on the malfunctioning of the Internet, in the event that it is not able to execute the order in the time provided by the contract.
INCONTRI cannot be held responsible for damages, losses and costs suffered by the Customer as a result of the non-execution of the contract for reasons not attributable to it, having the Customer only the right to the restitution of the price paid and any additional charges incurred.
INCONTRI does not assume any responsibility
INCONTRI assumes no responsibility for any fraudulent or illicit use that may be made, by third parties, of credit cards at the time of payment for products purchased, if it proves to have taken all possible precautions based on the best science and experience of the moment and on ordinary diligence.
In no case will the Customer be held responsible for delays or mishaps in payment if he/she demonstrates that he/she has made the payment in the time and manner indicated by INCONTRI.

These General Conditions are subject to Italian law.

In the event of a dispute with a Customer, INCONTRI guarantees as of now its participation in an attempt at friendly conciliation that the user may promote before RisolviOnline, an independent and institutional service provided by the Arbitration Chamber of the Chamber of Commerce of Milan, which allows to reach a satisfactory agreement, with the help of a neutral and competent conciliator, in a friendly and safe way.
If the parties intend to take recourse to the ordinary Judicial Authority, the dispute will be submitted to the competence of the Court of the place of residence or elective domicile of the Client or, at the choice of the Client himself, to the competence of the Court of Milan.
